This transfer application has been filed seeking transfer of an application under Section 24 of the Hindu Marriage Act, which is stated to have been filed by the applicant in a petition under Section 9 of the Hindu Marriage Act for restitution of conjugal rights, filed by the husband.
It is admitted by counsel for the applicant is that the main case under Section 9 of the Hindu Marriage Act has since been transferred from Gautam Budh Nagar to Kanpur Nagar under orders of this Court in a transfer application under Section 24 Hindu Marriage Act.
Once, the main case has been ordered to be transferred, it necessarily entail transfer of all applications pending therein. The application under Section 24 of the Hindu Marriage Act, does not have an independent existence.
Under the circumstances, this transfer application is misconceived and is dismissed, as such.
