Heard learned counsel for the petitioner.
Petitioner is before this Court with a request to decide the application dated 22.5.2018 for re-admission of Appeal No. Nil/2018 (Edal Singh Vs. State of U.P.) along with Stay Application dated 8.5.2018 pending before the District Judge, Agra.
At the very outset, learned counsel for the petitioner has placed the order dated 19.7.2018 passed by this Court in MATTERS UNDER ARTICLE 227 No. - 4687 of 2018 (Hakim Singh Vs.
Additional Collector Agra) and request has been made that the present petition may also be decided in terms of the said order.
In this backrop, the Court has proceeded to examine the record in question and find substance in the contention raised by learned counsel for the petitioner. For ready reference the operative portion of the order dated 19.7.2018 is quoted as under:-
"Considering the above, this petition stands disposed of with the direction upon the Court concerned to consider and decide the application dated 22.5.2018 for admission of Appeal No.Nil/2018 (Hakim Singh vs. State of UP) in accordance with law on the next date fixed in the matter i.e. 27.7.2018 and in case there is any inconvenience on the next date, the same may be decided as expeditiously as possible and preferably within four weeks from the date of production of certified copy of this order, without granting unnecessary adjournment to either of the parties, except upon payment of cost. "
In view of above, the Court is satisfied with the aforesaid order, having due regard to the prayer made in the writ petition, which shall meet the ends of justice. Consequently, present writ petition is also disposed of in same terms as in Hakim Singh (Supra).
