JUDGMENT / ORDER

This Court had passed order on 21/6/2012 as under.
" Learned AGP submits that this matter is assigned to learned Additional Government Pleader and the same may be adjourned to 03.07.2012, so that, briefing could be completed. Learned advocate Mr. Vasavada for the respondent has no objection.
At the request, the matter is kept on 03.07.2012, with the direction that no further time will be given as the matter is of the year 1993."
Today when the matter was called out none has remain present even to make a mention for adjourning the matter. In light of this, the Court is left with no alternative but to dismiss the same for default.
[ S.R. BRAHMBHATT, J ] Ms.
Pathak, learned AGP, before the aforesaid order was signed requested for restoring the same. She submitted that in fact she had gone for receiving instructions and therefore, nobody could remain present for even seeking indulgence for keeping it back or adjourning the matter. In light of this, the request is accepted. It is noted that she is unable to conduct the matter, which is assigned to learned Advocate General. Be that as it may, the restoration of the matter should be ordinarily made on the same day. However, in the peculiar facts & circumstances which she has submitted, the Court is inclined to restore the matter as the last opportunity. Adjourned to 11/7/2012. No further time shall be granted. As the date is prayed by learned AGP after obtaining proper instructions, it is expected that same shall not be changed and the matter must be proceeded with on the next date, i.e. 11/7/2012.
