Heard learned counsel for the petitioners, Sri Rajnish Kumar Rai, learned counsel for the respondent No. 2 and perused the record.
Present writ petition has been filed challenging the order dated 12.07.2017 passed by Railway Claims Tribunal, Ghaziabad.
Sri R.K. Rai has raised preliminary objection that Section 23 of the Claims Tribunal Act, 1987 provides for appeal against any order being not an interlocutory order.
Learned Tribunal has also rejected the application of the petitioner only on the ground of alternative remedy of Appeal.
Therefore, under the facts and circumstances of the case, I find no good ground to entertain this petition.
The writ petition is dismissed with liberty to the petitioner to file appeal as provided under Section 23 of the Claims Tribunal Act, 1987.
