On the basis of a sale deed executed by one Radhey Shyam, respondent no.5, the respondent no.4 filed an application for mutation. On 8.12.2016, Durga Prasad (petitioner) filed an application for staying the proceedings, saying that the proceedings be stayed till such time as proceeding before the Consolidation Court were not finalized. This application was rejected and, thereafter, this writ petition has been filed. In 1976 RD Page 220 it has been held that mutation proceedings were independent of the proceedings which might be going on in any other Court.
Under such circumstances, no interference is required to be made in the impugned order.
Accordingly, the writ petition stands dismissed.
However, orders of the Mutation Courts would be governed by the findings which might be arrived at in the regular suit subsequently.
