For Petitioners : Mr.N.Thirumalai For respondents : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the second respondent not to harass the petitioners based on the legal notice dated 3.1.2017 except due process of law.
2. It is the case of the petitioners that since the second petitioner was in need of money, he borrowed a sum of Rs.3,00,000/- from the fourth respondent at 10% interest on weekly basis. Though the second petitioner paid interest for four weeks, thereafter, he could not able to pay the interest because of his business debacle and hence, he explained his situation to the fourth respondent. However, the fourth respondent demanded exorbitant interest and threatened him. Subsequently, the third respondent has also started to threaten the petitioners on the premise that the amount belongs to him. Hence, the petition.
3. Today, when the matter was taken up for consideration, on instructions, learned Additional Public Prosecutor submitted that no such harassment was made by the respondent police and the presence of the petitioners is required only for completion of enquiry in CSR No.15 of 2017.
4. In view of the said submission made by the learned Additional Public Prosecutor, the petitioners are directed to appear before the second respondent police on 28.2.2017 at 10.00 a.m., for completion of enquiry in CSR No.15 of 2017, on which date, the second respondent police is directed to complete the enquiry. The present criminal original petition is disposed of accordingly.
