Learned APP, waives service of rule on behalf of respondent-State.
At the outset it is not in dispute that the parties namely the accused herein and the complainant have arrived at settlement and the said settlement dated 5.1.2012 signed by the parties is produced on record and basically the dispute had arisen out of business transaction and considering the above aspect,I deem it just and proper to quash and set aside the impugned complaint in this application as prayed for in para 8(b) and (c) of this application so as to secure the end of justice and not to relegate the accused-applicants to face rigor of the trial Court.
However, the petitioner shall deposit Rs.5,000/- with Gujarat State Police Housing Corporation, Gandhinagar.
Rule is made absolute.
Direct service is permitted.
