Rule.
Mr. Desai, learned AGP wavies the service of rule on behalf of respondents.
1. By way of this application, the applicant has prayed to release him on temporary bail for a period of thirty days.
2. Heard.
I have perused the relevant record. The applicant is sentenced to undergo imprisonment for seven years for the offence punishable under Section 307 of the I.P.C.. The applicant has preferred the present application seeking his release on medical ground. In support of his case, the applicant has produced Medical Certificate dated 27.06.2008 issued by Dr. A.K. Verma, Medical Officer, Central Jail Ahmedabad which is ordered to be taken on record. From the said certificate it transpires that the applicant is suffering from Leprosy and multiple non-healing ulcer. The applicant is aged about sixty years and he has been in jail for about ten months. Taking into consideration the aforesaid facts, the application deserves to be allowed partly.
3. In the result, the application is partly allowed. The applicant will be released on temporary bail on his personal bond in the sum of Rs.2,000/- for a period of TWENTY DAYS only, from the date of his release. It is made clear that on completion of the aforesaid period, the petitioner will surrender before the Jail Authority immediately. Rule is made absolute to the aforesaid extent.
