2. The Miscellaneous Petition No.2 of 2008 has been filed to condone the delay of 214 days in filing the CMA.SR.No.5313 of 2007.
3. When the matter came up for hearing on 07.03.2017, there was no representation on behalf of the Petitioner/Appellant. Hence, this Court directed the Registry to post the matter today under the caption "for dismissal". Even today, there is no representation on behalf of the Petitioner/Appellant. Hence, M.P.No.2 of 2008 in C.M.A.No.SR.5313 of 2007 is dismissed for non-prosecution. Consequently, the C.M.A.SR No.5313 of 2007 is rejected. No costs.
