JUDGMENT / ORDER

The petitioner has filed this petition under Article 226 of the Constitution of India r/w. Section 482 of the Code of Criminal Procedure, 1973 with the following main prayers:
"[B] This Honourable Court be pleased to direct the learned Judicial Magistrate, First Class, Mangrol, to forthwith proceed with the Criminal Complaint No.30/2010 pending before the Court and further be pleased to direct the learned Judicial Magistrate, First Class, Mangrol, to conclude the entire complaint proceedings / trial within a stipulated period as may be directed and felt just fit and proper by this Hon'ble Court, in the interest of justice.
[C] Pending admission, hearing and/or final disposal of this petition, this Hon'ble Court be pleased to direct the learned Judicial Magistrate, First Class, Mangrol, to forthwith pass an order on the police report dated 23/1/2011 submitted by the Police Inspector, Mangrol Police Station, in Criminal Complaint NO.30/2010 as part of the inquiry conducted under section 202 of the Cr.P.C."
2. As per the report of the Police Sub-Inspector dated 23.01.2011, upon recording statements of the parties, prima facie it transpired that the subject matter of the complaint is a gift deed and no offence is made out.
3. In the circumstances, no direction as prayed by the petitioner in this petition, is required to be issued to the learned Magistrate, at this stage.
