By order dated 21.4.2015, this Court directed Secretary, Medical & Health Anubhag-4, U.P.Government, Lucknow to take decision for reinstatement of the applicant in service within two months from the date of production of certified copy of the order.
Sri P.K. Giri, learned Additional Chief Standing Counsel, on instructions, states that decision has been taken by the Principal Secretary, Chikitsha Anubhag - 8, U.P. Government, Lucknow in pursuance of the direction issued by the writ Court. The decision is dated 4.9.2018 and has been placed for perusal before this Court.
Counsel for the applicant does not dispute that a decision has already been taken whereby, the period under which he was on suspension shall be counted for the purpose of service rendered by the applicant, but he would not be entitled for salary except the subsistence allowance.
Since a decision has already been taken in the matter, therefore, this Court is not inclined to proceed any further in the instant matter. The contempt application is consigned to record.
