1. Heard learned counsel for petitioner, and Sri Neeraj Tripathi, Advocate, for respondents.
2. Petitioner has sought a mandamus commanding respondent-1 to decide his representation/ objection dated 05.10.2017 but we find that the same is addressed to Vice-Chancellor of Deen Dayal Upadhyay Gorakhpur University, Gorakhpur and not Chancellor.
3. Admittedly, petitioner has a statutory remedy of approaching Chancellor under Section 68 of U.P. State Universities Act, 1973 (hereinafter referred to as “Act, 1973”). Therefore, we do not find any reason to interfere in the present matter and petitioner may avail the aforesaid alternative remedy.
4. Mandamus sought by petitioner cannot be granted since no Reference has been made by petitioner to Chancellor till date. Hence the writ petition is dismissed on the ground of alternative remedy.
