Heard learned counsel for the parties.
The petitioner retired while serving under the respondents in 2020. He has, however, been named in a criminal case which came to be registered in 2019 for commission of an offence including those relating to Section 7 of the Prevention of Corruption Act. It is in the aforesaid backdrop that the grant of pensionary and other retiral benefits have been withheld. Undisputedly, in the present case, the provisions of Regulation 919-A of the Civil Services Regulations as applicable in the State of U.P. would apply.
Learned Standing Counsel, in view of the aforesaid, submitted that the claim of the petitioner for grant of provisional pension during the pendency of judicial proceedings noted above, shall be examined and a final decision in respect thereof communicated with expedition and preferably within a period of four months from the date of presentation of a duly authenticated copy of this order.
Accordingly, this petition shall stand disposed of in light of the statement noted above.
