Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Civil Judge (SD) City, Farrukhabad be directed to expedite the hearing and decide the Original Suit No. 171 of 2017 within a time bound period.
Admittedly, the suit is of the year 2017. As such, I am not inclined to issue any direction as has been prayed for.
At this stage, learned counsel for the petitioner has pointed out that a compromise has taken place between the parties. The compromise has also been placed on record and the statements to that effect have also been recorded. Submission, therefore, is to decide the suit expeditiously.
Without going into the correctness of the assertions made by learned counsel for the petitioner, the present petition is finally disposed of with liberty to the petitioner to move appropriate application before the Court below for expeditious disposal of the suit, which shall be considered and decided sympathetically on the basis of the record and as per the roster of the case.
The Court is of the opinion that if a compromise has taken place between the parties, the Court below should decide the suit expeditiously in accordance with law, provided there is no other legal impediment With the aforesaid observations/ directions, the present petition is finally disposed of.
