JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 24422 of 2013 Petitioner :- Dr. Jayantika Kala And Anr. Respondent :- State Of U.P.& Another Counsel for Petitioner :- Alok Mishra Counsel for Respondent :- C.S.C.
Hon'ble Sudhir Agarwal,J. Hon'ble Ifaqat Ali Khan,J.
1. Called in revise. None appeared on behalf of petitioners. However, we ourselves have perused the record.
2. By means of the present writ petition, petitioners have sought the following reliefs:
“(a) Issue a writ, order or direction in the nature of mandamus commanding the respondents to permit the petitioners to continue in service till he reaches the age of superannuation at 65 years in terms of University Grants Commission Regulation, 2010.
(b) Issue a writ, order or direction in the nature of mandamus commanding the respondents to issue an order and direction that the petitioners shall be deemed to continue till the age of 65 years.”
3. However, we ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
Order Date :- 29.5.2018 AK
