… RESPONDENT (BY M/S RAJA GOPAL ASSOCIATES, ADVOCATES) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO PASS THE ORDER REQUESTED BY PETITIONER – 1 AS IN ANNEXURE – D AND ETC., THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Petitioner was appointed as an Assistant Professor in Tumkur University on 27.05.2010 and subsequently, discharged by the University on 21.02.2011.
2. Petitioner challenged the discharge order in W.P.No.10085/2013 before this Court. This Court by order dated 01.06.2015 has dismissed the said writ petition. Thereafter, petitioner filed the present writ petition for a prayer which reads as under:
“If the petitioner’s confession of the sexual harassment complaint, proved that, the sexual harassment complaint was due to Kaveri water politics/violence, then pass the order requested by petitioner as in Annexure- E, else if, the sexual harassment is genuine, then pass the order requested by petitioner as in Annexure-F for the Discharge Order No.ORDER:TU:EST:E- 1:2010-11:2876 dated 21.02.2011 (Annexure-B) by the respondent University”.
3. Shri Dr.B.Raghavendra, party-in-person submitted that though the learned Single Judge of this Court has dismissed W.P.No.10085/2013, he seeks for an order in terms of the prayer extracted above.
4. To a pointed query, grievance of the petitioner is with regard to discharge order dated 21.2.2011. Admittedly, discharge order was challenged before this Court in W.P.No.10085/2013 and same has been dismissed on 01.06.2015. In the circumstances, no further relief can be granted in this writ petition.
5. Resultantly, petition fails and it is accordingly dismissed.
No costs.
