JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) The petitioner has sought a direction, setting aside notice dated 6.10.2011 of respondent no.1 calling for bids for issuing license to do business of eatables and other items in the premises of the respondents, who are running the State Public Transport Service and propose to utilize space at Nizampura Bus Depot near Vadodara. The petitioner is stated to be holding license to run a restaurant and a dry fruit stall in the same bus depot. In order to justify prevention of other entrants in the business, the petitioner has relied upon the policy of the respondents contained in Circular No.5, dated 30th June 2010. That policy, however, is by its very heading and provisions, applicable to issuance of hawkers' license and does not apply to issuance of license to stalls within the premises of bus depots. Since there is no other basis for claiming any relief and as the policy does not apply in the facts of the present case, the petition is summarily dismissed.
