This criminal appeal has been filed against the Judgement and order of conviction dated 04.03.1997 passed by Vth Additional District and Sessions Judge, Moradabad in Sessions Trial No.
546 of 1996 sentencing the appellant to undergo rigorous imprisonment of five years along with fine of Rs. 1000/- for the offence under Section 307/34 I.P.C.
Notice issued to the appellant has been received back with the report of the Chief Judicial Magistrate, Moradabad dated 02.04.2021 stating therein that the sole appellant Dinesh has expired.
Accordingly, the instant appeal is dismissed as abated.
