Heard Sri Ashok Khare, learned Senior Counsel for the petitioner and learned Standing Counsel has appeared for the respondents.
The petitioner is working as a Joint Commissioner in the Commercial Tax Department. He was put under suspension on 26.04.2017 and a disciplinary inquiry was instituted against him. The inquiry report has been submitted on 29.01.2018 and none of the two charges have been found proved against the petitioner.
In this background, petitioner has preferred this petition for the direction upon the respondents to reinstate him on the post of Joint Commissioner Tax and to pay arrears of salary from the date of suspension till date.
In view of the fact that an inquiry report has already been submitted against the petitioner and till date no final decision has been taken on it by the disciplinary authority, we dispose of the writ petition with the direction to the disciplinary authority to consider the above inquiry report and to pass an appropriate order in accordance with law, most expeditiously, if possible within a period of six weeks from the date of authentic copy of the order is produced before him.
It is needless to mention that the suspension of the petitioner would abide by the final decision of the disciplinary authority to be taken as directed.
