Court No. - 48
Case :- CRIMINAL MISC. BAIL APPLICATION No. - 45223 of 2019 Applicant :- Dilshad Opposite Party :- State of U.P.
Counsel for Applicant :- Umair Mahmood Counsel for Opposite Party :- G.A.
Hon'ble Pritinker Diwaker,J.
Heard Sri U. Mahmood, learned counsel for the applicant and Sri J.K. Upadhyay, learned AGA for the State.
As per prosecution case, deceased Kamil used to tease the wife of the applicant as a result of which frequent quarrel used to take place between the two. It is said that on 21.2.2019, deceased had passed certain unwanted comments against the wife of the applicant over which the dispute again cropped up and then with the help of co-accused, accused appellant eliminated the deceased.
Counsel for the applicant submits that the applicant has been falsely implicated and co-accused persons have already been granted bail.
Opposing the bail application, it has been argued by the State counsel that incident has been witnesses by Riyasat, Sharafat and Jaheer and they have duly supported the prosecution case.
Considering the statements of witnesses, I am not inclined to release the applicant on bail. His bail application is, accordingly, rejected. The trial court is, however, directed to expedite the trial.
