JUDGMENT / ORDER

Mr.Nishant Lalakiya, learned advocate for respondent No.1-the Commissioner, Rajkot Municipal Corporation, upon receipt of an advance copy of the petition, states, upon instructions, that the auction proceedings that have been challenged in the petition, have been cancelled, therefore, the grievance of the petitioner would no longer survive.
At this stage, Mr.A.S.Vakil, learned advocate for the petitioner states that in view of the statement made by Mr.Nishant Lalakiya, learned advocate for respondent No.1, the grievance of the petitioner, as voiced in the petition, would no longer survive and the petition may be disposed of, accordingly, and he may be permitted to withdraw the petition.
Permission to withdraw the petition, is granted.
The petition is disposed of, as withdrawn.
