Learned counsel for the petitioner states that petitioner No. 1 has already been arrested and, therefore, the writ petition has rendered infructuous. He is pressing writ petition only with regard to the petitioner No. 2.
After some arguments, learned counsel for the petitioners submitted that he wants to withdraw the writ petition and the same may be dismissed as not pressed with liberty to apply for anticipatory bail.
In any case, petitioner has an alternative remedy to seek anticipatory bail, we deem it appropriate to dismiss the petition without prejudice to the right of the petitioner to apply for anticipatory bail.
The writ petition is, accordingly, dismissed.
