Dheer Pratap Singh vs Union Of India And Ors

High Court Of Judicature at Allahabad|17 April, 2017
|

JUDGMENT / ORDER

Court No. - 37
Case :- WRIT - A No. - 15008 of 2017 Petitioner :- Dheer Pratap Singh Respondent :- Union Of India And 5 Ors.
Counsel for Petitioner :- Hausihla Prasad Mishra,Jitendra Narayan Tripathi Counsel for Respondent :- A.S.G.I.
Hon'ble Vikram Nath,J.
Hon'ble Daya Shankar Tripathi,J.
Heard learned counsel for the petitioner and Sri S.K. Rai, learned counsel for the respondents.
Claim of the petitioner for compassionate appointment was rejected by the Tribunal on the ground that after 30 years of the death of his father no purpose would be served by extending benefit of the scheme of compassionate appointment.
We are also of the view that once substantial time has passed after the death of the bread earner of the family and his family sustained in the financial crisis at that time. Extending compassionate appointment after long lapse of 30 years is against the spirit of the scheme made for the purpose.
We, accordingly, do not find any infirmity in the order of the Tribunal.
Writ petition lacks merit and is accordingly dismissed.
