Dharmeshkumar vs State

High Court Of Gujarat|06 July, 2012

JUDGMENT / ORDER

1. Rule.
Learned APP, waives service of rule on behalf of respondent-State.
2. This application is filed by the applicant for modification/deletion of conditions No. 7 (iii) and (iv) imposed in order dated 26.12.2005 in Criminal Misc. Application No. 14286 of 2005.
3. Learned advocate for the applicant submits that the passport of the applicant surrendered in the lower Court pursuant to order dated 26.12.2005 needs to be renewed and accordingly condition No. 7 (iii) and (iv) deserves to be relaxed/modified.
4. Considering the above aspect, I am inclined to allow this application for modification of above two conditions i.e. 7 (iii) and (iv) permitting the applicant to receive his passport so as to get it renewed and thereafter to deposit before the concerned Court. However, condition No. 7(iv) stands deleted and other conditions of the bail order to remain as they are.
5. Rule is made absolute. Direct service is permitted.
