By means of this application, the applicant has questioned the order of recovery warrant dated 30.11.2017.
At the very outset, the applicant submits that the counsel for the applicant is ready to deposit entire amount in three equal installments, one falling on 10.02.2019, the second on 10.03.2019 and the third one on 10.04.2019 and shall continue to deposit monthly maintenance amount as directed by the court below.
In view of the above, undertaking being so given by the applicant through his counsel before the Court, the order dated 30.10.2018 is put in abeyance provided the applicant continues to deposit Rs. 4,000/- per month falling on every 10th day of the month. The arrears at the rate of Rs. 4,000/- from November, 2017 shall be deposited in three equal installments, one falling on 10.02.2019, the second on 10.03.2019 and the third one on 10.04.2019.
However, it is further directed that in the event of default of any of the observations contained hereinabove, this interim protection shall cease to operate and the Court below shall adjudicate the proceedings in accordance with law for the recovery of the amount of maintenance and no further petition shall be entertained in this regard.
