Petitioners want consideration of their application contained in Annexure No.2 to the writ petition. This application is addressed to the District Magistrate, Auraiya and the grievance raised is against private respondent about encroaching petitioners' land.
Their appears to be a private civil dispute in respect of immovable property between petitioners and private respondent. Such issue can always be got examined by instituting appropriate proceedings before the civil court where parties can lead evidence to determine factual issues. Writ petition is not the remedy for such purposes. No direction can be issued to the administrative authorities to decide such issues.
Leaving it open for the petitioners to approach before the appropriate forum, this writ petition is consigned to records.
