Heard Sri Rajnish Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for State-Respondents no. 1 to 3.
By means of this writ petition, the petitioner is claiming himself to be Lecturer (Commerce) appointed by the Joint Director of Education under the Removal of Difficulties Order-I. The said appointment was also duly approved with financial sanction by the District Inspector of Schools and since 1998 the petitioner is getting salary from the State Exchequer. The petitioner has now now claims that from the date of his joining i.e. 22.12.1998 the petitioner is continuously working, therefore, after enforcement of section 33(G) of U.P. Act No. 5 of 1982 Act, the petitioner is entitled for regularization for which papers have been forwarded to the Joint Director where the claim of the petitioner is pending.
The writ petition is disposed of with a direction to the respondent no. 2 to decide the claim of the petitioner in accordance with law after verifying the mode of his appointment. The said decision shall be taken by the Joint Director within a period of three months from the date of presentation of certified copy of this order before it.
