(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict, through his mother, who is present in the court, has prayed that he be enlarged on temporary bail since the mother of the convict is to be operated for her Gynec problems on 12.04.2012.
Learned APP Shri Pandya has submitted that on verification it is found that the ground mentioned in the application is genuine.
From the jail remarks, we find that whenever the applicant was enlarged on temporary bail or was on furlough, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is directed that the applicant-convict shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5000 and one surety of like amount. It is further directed that that upon expiry of the said period, the applicant-convict shall surrender to the jail authority in time.
Application allowed to the aforesaid extent. Rule made absolute accordingly. D.S.
