Heard Sri Rajesh Yadav, learned counsel for petitioner, Sri H.
N. Singh, learned Advocate, holding brief of Sri Azad Rai, learned counsel for the Gaon Sabha/ respondent no.4, learned Standing Counsel who represents respondent no.1 and perused the record.
Present petition has been filed by the petitioner for direction to the Settlement Officer of Consolidation, Prayagraj (respondent no.1) to decide the Appeal No.979 (Computarikrit Case No.2019540203000192) (Dharam Devi Vs. Sunil Kumar and others), under section 11(1) of Consolidation Act.
It is submitted by learned counsel for petitioner that against the order dated 13.08.2001 passed by Consolidation Officer in the proceeding under section 12 of UPCH Act, petitioner has preferred an appeal dated 31.10.2019 (Annexure No.1) under section 11(1) of UPCH Act. It is submitted that aforesaid appeal is still pending since 31.10.2019 in the court of Settlement Officer of Consolidation, Prayagraj(Annexure No.1). Till date no fruitful steps has been taken to decide the aforesaid appeal finally. Same has been left protracted.
In this conspectus as above, no useful purpose would be served to keep this matter pending, therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Settlement Officer of Consolidation, Prayagraj(Annexure No.1), before whom appeal dated 13.10.2019 is pending disposal, to decide the same expeditiously, preferably, within the period of five months from the date in receipt of copy of this order.
It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.
The petitioner shall file computer generated copy of such order downloaded from the official website of High Court, Allahabad supported by an affidavit, which shall be verified by the concerned authority from the website of the High Court, Allahabad.
With the aforesaid observation, present writ petition is disposed of.
