Heard Sri I.K. Singh, learned counsel for the applicant, Sri A.R. Chaurasia, learned A.G.A. for the State.
It has been contended by the learned counsel for the applicant that P.W. 1 has turned hostile before the trial court and has not supported the prosecution case. The applicant is in jail since 11.7.2017.
Learned A.G.A. has vehemently opposed the prayer for bail and submitted that as per the F.I.R. there is specific allegation of firing shot at the deceased against the applicant. The deceased as per the post mortem report died on account of fire arm injury. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Dharampal @ Dhanpal involved in Case Crime No. 618 of 2017 under section 302, 506 I.P.C., police station Aligarj, District Etah.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within a period of six months from the date of production of a certified copy of this order.
