This appeal was preferred by Dharam Veer against the judgement and order dated 17th September, 1983, passed by Special Sessions Judge, Meerut in sessions Trial No.421 of 1981 whereby the appellant was convicted under Section 307 IPC and sentenced to undergo rigorous imprisonment for three years.
On 5th November, 2016, this Court had passed following order:
"Case called out. No one is present on behalf of the appellant even in the revised list.
Lower court's record has been received. Issue notice to the appellant.
List on 19.12.2016 after service of notice upon the appellant."
Pursuant to the order dated 5th November, 2016, office has submitted its report dated 17th December, 2016 annexing therewith letter received from Chief Judicial Magistrate, Baghpat dated 29th November, 2016. On the basis of the aforesaid report submitted by Chief Judicial Magistrate, Baghpat, the office has submitted that appellant Dharam Veer has died eight years before.
In view of above, the appeal has abated and is accordingly
dismissed as having abated.
