This application u/s 482 Cr.P.C. has been filed seeking the quashing of charge sheet dated 08.05.2018 and cognizance order dated 21.08.2018 as well as the entire proceedings of Criminal Case No.887 of 2018 (State vs. Dharamveer) arising out of Case Crime No.0032 of 2018, under sections 323, 504, 506 I.P.C., Police Station- Badgaon, District- Saharanpur, pending in the Court of Judicial Magistrate Deoband, Saharanpur.
Heard applicant's counsel.
The only submission made by the counsel is that with regard to the F.I.R. that was made against the opposite side proceedings have been stayed and therefore the proceedings of the present case should also be stayed. No other submission has been made by the counsel.
Heard learned A.G.A. and perused the record.
Whether the proceedings are stayed or not stayed, depend upon the facts and circumstances of that particular case. Certain order has been passed in a particular case must have depended upon the peculiar facts of that case. There is also an argument to entertain a case of which the proceedings were stayed and therefore the proceedings of the present case should also be stayed. Perusal of the record shows that prima facie commission of offence is made out. There is no good ground to quash or stay the impugned proceedings.
In view of the aforesaid observations the present applications stands dismissed.
