Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition seeks a direction for promotion of the petitioner on the post of Sub Inspector on the basis of his placement in the seniority list of Head Constables as published on 28 February 2018.
Learned counsel states that the case of the petitioner is not being considered since an adverse entry was awarded and recorded against him on 26 September 2017. However, from a perusal of paragraph 7 of the promotion notification dated 28 February 2018, it is evident that the service record for the period 2007 to 2016 with a cut off date of 1 July 2017 was prescribed. In view thereof, learned counsel for the petitioner contends that since the order of punishment came to be passed after 1 July 2017 his claim for promotion cannot be denied.
Learned Standing Counsel submits that subject to all contentions on merits being left open, the sixth respondent shall duly consider the claim of the petitioner and dispose of the same in accordance with law in any case within two months from the date of presentation of a certified copy of this order.
Accordingly and without going into the merits of the claim of the petitioner, this petition shall stand disposed of in light of the statement noted above.
