Heard Shri Ramakant Gupta holding brief of Shri Ram Raj Prajapati, learned counsel for the petitioner and Shri Hare Ram Tripathi, learned Standing Counsel for the respondents.
The petitioner is stated to be working under the respondent no.4, Darbari Industries Manufacturers, Allahabad and in an accident his three fingers were injured. The petitioner is claiming fund, gratuity, insurance and medical expenses.
It has not been shown as to how the respondent no.4 is a 'State' within the meaning of Article 12 of the Constitution of India. Undoubtedly the respondent no.4 is a private industry and does not have any attribute of State.
For reasons aforesaid, the writ petition is not maintainable in the High Court and is accordingly dismissed as such.
