1. By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail for construction of house for his family.
2. Pursuant to the earlier order passed by this Court, learned APP Shri Pandya, based on the report received by him from the Police Sub-Inspector, Vadgam, has submitted that the ground mentioned in the application is genuine. From the jail report, it appears that whenever the applicant-convict was enlarged on temporary bail or on furlough leave, he surrendered before the jail authority in time.
3. Considering the totality of the facts, it is directed that the applicant-convict be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs. 5000/- with one surety of like amount, with further direction that the applicant-convict shall surrender before the jail authority on expiry of temporary bail period. Application is allowed to the aforesaid extent. Rule is made absolute.
