Heard learned counsel for the petitioner and Sri Dilip Kumar, learned counsel appearing for all the respondents.
Present petition has been filed with following prayer:-
"Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 4 to execute the award dated 04.06.2018 passed by the Central Government Industrial Tribunal Cum Labour Court, Kanpur in Industrial Dispute No. 59 of 2006, Shri Ashok Kumar Singh, Vice President, Rashtriya Mazdoor Congress (INTUC), Agra Vs. The Deputy Superintending Horticulturist, Archeological Survey of India, Agra in favour of the petitioner or to transmit the aforesaid award dated 04.06.2018 to concern Civil Court for execution according to law."
The petitioners have already filed an application for execution of the award before respondent no.4 which is stated to be pending. The order sheet of the execution case has not been brought on record and thus, it is not possible to ascertain the stage of the execution proceedings.
Consequently, the instant petition is disposed of with direction to the fourth respondent to execute the award expeditiously, provided there is no legal impediment.
