JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - A No. - 9113 of 2019 Petitioner :- Devesh Kumar Mishra Respondent :- Union Of India And 3 Others Counsel for Petitioner :- P.K. Upadhyay,D.M.Tripathi Counsel for Respondent :- Rajnish Kumar Rai
Hon'ble Yashwant Varma,J.
Heard learned counsel for the petitioner. None has appeared for the respondents even when the matter is taken up in the revised call.
On 20 July 2018 the Appellate Authority had modified the punishment imposed upon the petitioner by providing that only two future increments would be withheld. The Appellate Authority had further observed that the period of unauthorised absence would be regularised against the leave if due in the account of the petitioner and in case that not be available it would be treated as dies-non and in any case not treated as a break in service. The grievance is that despite the order of the Appellate Authority, the claims of the petitioner have neither been computed nor necessary benefits released.
In view of the above this petition shall stand disposed of with a direction to the fourth respondent to attend to the claims of the petitioner as comprised in his representation dated 09 January 2019 forthwith and communicate his final decision within a period of two months from the date of presentation of a certified copy of this order.
Learned counsel for the petitioner is requested to apprise Sri Rajnish Kumar Rai of the passing of this order in writing.
Order Date :- 29.5.2019 faraz
