JUDGMENT / ORDER

The petitioner is challenging the recovery proceedings initiated by the respondent Bank. The petitioner has not complied with the interim order granted on 12.03.2013 and now seeks that he may be granted an instalment facility. If the petitioner has such a prayer, he shall move the respondent Bank for the same and the respondent Bank shall grant at least six monthly instalments. If the petitioner does not approach the respondent Bank requesting for instalments, within two weeks of receipt of a certified copy of this judgment, the respondent Bank will be free to proceed for recovery against the petitioner. If default is committed in making the instalments, the respondent Bank WP(C).21634/2012 2 will be free to proceed with the recovery. The writ petition is disposed of leaving the parties to suffer their respective costs.
