The petitioners had appeared in the Class 10 and Class 12 examinations conducted by the respondents-Board, on the strength of orders passed by this Court.
The counter affidavit discloses that there was some discrepancies in the details of the petitioners as forwarded by the institution. In para 18 of the counter affidavit, it is stated that despite requisition being made from the Board, the petitioner-institution had not sent the relevant details.
On account of the aforesaid failure of the-petitioner- institution, the students cannot be penalized.
The respondents-Board is directed to forthwith declare the results of the petitioners. However, appropriate proceedings shall be taken against the petitioner- institution in accordance with law for committing the aforesaid irregularities. The petitioners shall be given an opportunity of hearing before any action is taken against them.
The proceedings shall be completed and action shall be taken against the concerned institution in accordance with law within a period of four months from the date of production of a computer generated copy of this order downloaded from the official website of the High Court of Judicature at Allahabad, after giving due opportunity of hearing to the institution.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
The respondents-Board is also directed to create a proper system of penalization against the management of institution which does not cooperate with the respondents-Board or adhered to the guidelines of the Board.
With the above directions, the writ petition is finally disposed of.
The record has been produced. The same is returned to the concerned official of the respondents-Board who is present in the Court.
