1.0. Present application has been preferred by the applicant-original complainant for an appropriate order to transfer the Criminal Case No.1605 of 2005 pending in the Court of learned JMFC, Kadi to the Court of learned Metropolitan Magistrate Court, Ahmedabad city or any other Hon'ble Court.
2.0. It is to be noted that present application is of the year 2006 and still no steps are taken to serve respondent no.5.
3.0. Today, when the present application is taken up for final hearing, learned advocate for the applicant has chosen to remain absent. Hence, present application is dismissed for non prosecution. Rule is discharged.
