Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos. 1 and 3 and Sri A.K. Yadav, learned counsel for respondent no. 2.
Learned counsel for the petitioner submitted that petitioner appeared in Assistant Teachers Recruitment Examination, 2018. Result of the petitioner was declared in which he was given 61 marks and declared not qualified. He next submitted that the petitioner was not satisfied with the result, therefore, he has submitted an application to obtain photocopy of answer book after depositing Rs.2,000/- as provided in Rule. In the result of re-evaluation, the petitioner obtained 63 marks. The scanned copy of answer book has been provided to petitioner. He next submitted that from perusal of answer sheet provided by the respondents, it is clear that question nos. 6, 12, 20, 33, 35, 42, 43, 52, 101 and 104 solved by the petitioner are correct, but the respondents have not re-evaluated the aforesaid questions. Lastly, he submitted that a direction may be issued to respondent no.4 to recheck the answer books of petitioner and award marks to petitioner on those questions. He next submitted that petitioner has obtained 63 marks and cut off marks for selection and appointment on the post of Assistant Teacher is 67 marks, therefore, in case he is awarded 4 marks, he would be selected for appointment on the post of Assistant Teacher.
I have perused the question papers, model answer book and answers given by the petitioner and prima facie, answers given by the petitioner in question nos. 6, 12, 20, 33, 35, 42, 43, 52, 101 and 104 appear to be correct, therefore, under such facts and circumstances, respondent no.4 is directed to recheck the answer book of the petitioner within two months from the date of production of certified copy of this order and provide result to the petitioner after rechecking the answer book within the same time.
With the aforesaid observations, the writ petition is disposed of.
