Heard the counsel for the petitioner.
The present writ petition has been filed against the order dated 6.10.2018 passed by the Deputy Director of Consolidation whereby the restoration application of the petitioner has been dismissed.
It transpires from the order dated 6.10.2018 that the revision filed by the petitioner was twice dismissed by the Deputy Director of Consolidation vide his order dated 18.8.2008 and 28.10.2009 but the said orders were recalled on the application filed by the petitioner. Subsequently, the petitioner filed an application dated 12.11.2013 stating that he did not want to press the revision and was agreeable to the Chaks allotted till the stage of Settlement Officer of Consolidation. On the aforesaid application of the petitioner, the revision was dismissed as not pressed vide order dated 23.11.2013. The restoration application filed by the petitioner for recall of the order dated 23.11.2013 has been dismissed through order dated 6.10.2018.
The Court has taken notice of the fact that the revision was filed by the petitioner in 2002 itself.
The recall application was filed by the petitioner on 2.3.2015. The order dated 23.11.2013 was passed by Deputy Director of Consolidation on the application filed by the petitioner himself and therefore, no illegality has been committed by the Deputy Director of Consolidation, Sambhal in dismissing the recall application filed by the petitioner vide his order dated 6.10.2018.
The writ petition lacks merit and is dismissed.
