Heard Sri Kartikeya Saran, learned counsel for the petitioner and Sri Shashi Prakash Narayan, Advocate holding brief of Sri Ajeet Kumar Singh, learned counsel for the respondents.
The respondents invited tenders ID No. 2017_BHU_190946_1. The petitioner was the lowest bidder and his tender was accepted but instead of awarding contract, the tender process was cancelled by letter dated 16.02.2018.
During the pendency of the writ petition respondents have stated that the aforesaid letter has been withdrawn.
Learned counsel for the respondents has produced photo-copy of the letter dated 21.04.2018 issued by the respondent no. 2 to the petitioner stating that the University reconsidered and reviewed its decision on 10.01.2018 communicated vide letter dated 16.02.2018, and in the fairness of the procedure, it has been resolved that the viability issue raised by Apollo hospital be referred to you for explanation and comments.
In the view of above, as the order cancelling the above tender process has been recalled, nothing survives in the writ petition for adjudication and the same is disposed of with the direction to the respondents to finalize the tendering process as expeditiously as possible, if possible within a period of six months.
The writ petition is dispose of.
