Heard learned counsel for the parties.
By the instant writ petition, petitioner seeks a writ of mandamus directing the third respondent-Sub Divisional Magistrate, Tehsil Khalilabad, District Sant Kabir Nagar to consider his application for exchange of his bhumidhari land (Gata No. 38 area 0.2410 hectare and Gata No. 30M area 0.3380 hectare with Gaon Sabha land (Gata No. 193 area 0.0200 hectare and Gata No. 192 area 0.0210 hectare.
Learned Standing Counsel and the learned counsel appearing for the Gaon Sabha submits that the third respondent shall consider and decide the application of the petitioner, in accordance with law.
In view thereof, without entering into the merit of the case, the writ petition is being finally disposed of directing that the third respondent, Sub Divisional Magistrate, Tehsil Khalilabad, District Sant Kabir Nagar, shall consider and decide the application of the petitioner by a reasoned and speaking order, in accordance with law, expeditiously within three months from the date of filing of copy of this order along with copy of the application.
It is clarified that the Court has not considered the claim of the petitioner on merits.
