The present petition has been filed to issue a direction to the respondent not to interfere in the peaceful possession of the plaintiff over the land under Gata No. 29 area about 0.1380 Hectare situated at Village Dohra, Tehsil Amroha, District Amhora which according to the petitioner is land of Khalihan.
It is known to all that the Khalihan is a public utility land and no one can claim right over the said land. In case of any encroachment of any private person over the said land, it is always open for the petitioner to move appropriate application to bring the attention of the State Authorities to take action under Section 67 of the U.P. Revenue Code, 2006.
The suit seeking injunction with respect to Khalihan land itself is not maintainable and as such, no direction can be given.
The present petition is, accordingly dismissed.
