When the matter came up for hearing on 23.12.2016, there was no representation on behalf of the appellants and hence, it was directed to be posted today under the caption ?For dismissal?. Today, at about 11.15 a.m., when the matter was taken up for hearing, there was no representation for the appellants. However, it was passed over and at about 12.00 noon, when the matter was taken up for hearing, again there was no representation for him. In such circumstances, this Court has no other option except to dismiss the second appeal for non-prosecution.
2. Accordingly, the second appeal is dismissed for non-prosecution. No costs.
