Learned advocate for the applicant submits that previously application for regular bail is withdrawn before this Court and because of change in circumstances, this application is preferred again praying for regular bail.
Learned APP Mr.Dabhi submitted that previously the present applicant preferred regular bail application which has been withdrawn unconditionally and so question does not arise to entertain this application.
The order was passed in Criminal Miscellaneous Application No.17348 of 2011 on 16.01.2012 wherein the other accused were granted regular bail whereas the regular bail application was withdrawn qua the present applicant.
Considering the fact that withdrawal of the application qua the present applicant amounts to rejection and that from the reading of the complaint, there is specific demand of dowry and no change of circumstances are shown to consider grant of regular bail to the applicant, question does not arise to again decide the regular bail application of the present applicant on merits. In view of the above, this application is rejected.
