Heard learned counsel for the petitioners; Shri Rajesh Kumar Srivastava, learned Standing Counsel for the State respondent nos.1 to 3 and Shri Diwakar Singh, learned counsel for the respondent no.4.
The petitioners are assailing the order impugned dated 18.11.2008 passed by Tehsildar, Tehsil Meja, District Allahabad and for direction to the respondents not to interfere in their peaceful possession over Arazi No.689-Ta-Min, 689-Ga-Min, 689-Ya and 689-Cha situated in village Nibaiya, Pargana Kairagarh, Tappa-Chaurasi, Tehsil Meja, District Allahabad.
At the very outset, Shri Rajesh Kumar Srivastava, learned Standing Counsel as well as Shri Diwakar Singh, appearing for the respondents have raised preliminary objection that at this belated stage the petitioners cannot be permitted to assail the validity of the order dated 18.11.2008 and moreover, the said order is also appealable.
The Court has proceeded to examine the record in question and finds that the order impugned is appealable and as per report of the Stamp Reporter, the present writ petition has been filed with the delay of 9 years and 60 days.
In the aforesaid facts and circumstances of the case, the Court is not inclined to interfere in the matter.
The writ petition is dismissed on the ground of alternative remedy.
