This criminal revision has been preferred against the judgement and order dated 14.11.2017 passed by learned Sessions Judge, Kanpur Nagar arising out of Criminal Revision No.330 of 2017 (Vinod Kumar Jaiswal and another vs. State of U.P. and another), u/s 138 N.I. Act, Police Station- Kotwali, District-Kanpur Nagar whereby revision was partially allowed and the revisionist has been given only one opportunity to produce defence evidence.
Heard learned counsel for the revisionist and learned A.G.A. for the State and also perused the record.
Counsel for the revisionist has not been able to point out any such illegality, impropriety or incorrectness which may persuade this Court to interfere in the impugned order. The impugned order is a well reasoned order. The lower revisional court thought it fit, and rightly so to give one opportunity to the revisionist to furnish defence evidence. The lower revisional court also took care to observe that no further opportunity shall be given to the revisionist for defence evidence. The discretion exercised by the lower revisional court appears to have been rightly and properly exercised. There is no good ground to interfere in the impugned order or to substitute the same by its own.
The revision lacks merit and therefore same stands dismissed.
