Mr.Pandya, learned APP waives service of notice of Rule.
By way of this application, the applicant - convict has prayed that he be enlarged on temporary bail on the ground of marriage of his nephew, which is scheduled on 14.4.2012.
On the order having been passed in a cognate matter on earlier occasion, Mr.Pandya, learned APP, under the instructions of the Police Sub-Inspector, Dasada Police Station (District Surendranagar), has submitted that the ground is genuine.
From the jail report, it transpires that whenever the applicant was enlarged on temporary bail, he has surrendered in time before the jail authority.
Considering the totality of the facts, it is ordered that the applicant shall be enlarged on temporary bail from 12.4.2012 to 19.4.2012 on personal bond of Rs.5,000/-, with one surety of like amount, with the further direction that the applicant - convict shall surrender before the concerned jail authority on 20.4.2012.
The application is allowed to the aforesaid extent. Rule made absolute accordingly. Mr.Pandya, learned APP shall communicate the order to the concerned Jail Authority.
